Creator terms

The terms of use in German language apply exclusively. The following translation is for information purposes only.

You will be referred to as Creator in the following text. We, Interwebs GmbH, are called Company in the following text.

The Creator is given the opportunity to upload content that can be purchased and to conduct paid chats.

The company takes over the sale of the content and chats. To enable the company to fulfill this task, the creator transfers all usage rights to the media and content provided to the company.

In return, unless otherwise agreed, the Creator receives a commission in the amount of 80 % of the net value entered by the Creator per unit sold. The calculation basis is always the net value resulting from the gross value entered. The price entry on foxy.link is made in gross values including the VAT applicable at that time. A platform fee of 20 % is added to the price set by the Creator for the user; it is not part of the calculation basis for the commission.

The payout must be requested by the Creator in the account at https://foxy.link. The payout can be requested at intervals of 14 days, provided the balance is at least €50 net.

The payout is usually made 5 working days after the payout request. The banks' transfer times must be added together. A fully completed and verified profile is a prerequisite for a payout. The creator must be authorized to receive payments.

Commissions are available for payment for 365 days from the time the commission is assigned to the Creator Account. After 365 days, the commission expires. It is no longer possible to request payment of commissions that are older than 365 days.

The foxy.link service is aimed exclusively at persons of legal age (18 years of age or older). When registering, the Creator must provide proof that they are of legal age in order to use the service.

The Creator confirms to own the necessary rights to the content that is uploaded to foxy.link and then offered for sale by the company.

The creator can remove content from sale or delete it. This content will then no longer be offered for sale on foxy.link. Content already purchased by users is still available to them even after deletion.

The uploaded content may only show the verified creator himself. The depiction of persons other than the Creator themselves is prohibited. If the Creator publishes images of other people on foxy.link, this content will be deleted immediately and the profile permanently blocked. The entitlement to commissions will lapse completely.

Only one Creator profile per person may be created. Creating multiple profiles with the same civil identity is considered an attempt to deceive and leads to the immediate and permanent blocking of all profiles.

The Creator undertakes to behave in a lawful and conscientious manner. All content must comply with applicable law and must not violate these guidelines.

6.1 Prohibited content

The following content and postings are prohibited:

6.1.1 Illegal and harmful content

• Dissemination of illegal content of any kind
• Insults, threats, disparagement or other forms of defamation
• Depictions of violence, including:
  • Blood, injuries, mutilations
  • Torture or excessive brutality
• Prohibited acts or content that violate applicable law or the guidelines of payment service providers and the card associations

6.1.2 Content involving minors

• Any depiction of minors
• Content that suggests or imitates minority (e.g. clothing, behaviour, role play)
• Content that sexualises minors in any form
• Depictions that could be associated with minors – including animated or AI-generated content

6.1.3 Content involving animals

• Any sexual or sexualised depiction involving animals
• Content that directly or indirectly depicts or alludes to zoophilia

6.2 Rules on nudity and sexuality

6.2.1 Rules on nudity

Content depicting nudity is prohibited on foxy.link – including animated or AI-generated content. This applies in particular, but not exclusively, to the following depictions:

• Genitals and anus
• Touching or stimulation of genitals or nipples
• Insufficient covering of the genitals (e.g. underwear that is too narrow, transparent clothing)
• Fully exposed breasts in a provocative or sexualised context

6.2.2 Rules on the depiction of sexuality

Content showing sexual acts is prohibited – including animated or AI-generated content. This applies in particular, but not exclusively, to:

• Sexual acts of any kind (e.g. solo sex, sex with a partner, oral sex, masturbation, stimulation with sex toys)
• Display of erections
• Body fluids with a sexual connotation (e.g. sperm, ejaculate)
• Obscene or comparably inappropriate content

6.2.3 Permitted content depicting nudity

Exceptions to the rules in 6.2.1 and 6.2.2 may be granted if the content serves no sexual purpose. This includes in particular, but not exclusively:

• Educational content
• Content with a satirical reference
• Works of art

The decision on the approval of content lies exclusively with the Company. There is no entitlement to publication.

The decision to accept an application as a Creator is the sole responsibility of the company. There is no right to use foxy.link. The Company is solely responsible for deciding whether to enable or disable individual functions for the Creator. The Creator has no right to the activation or use of certain functions. The Creator has no claim to a specific listing on foxy.link. The presentation, order or other highlights are the sole responsibility of the company. The company has sole discretion over the approval of content uploaded by the creator. The company alone determines the review and approval criteria. The creator has no right to have uploaded content approved.

The Creator shall indemnify the Company against all claims asserted against the Company by third parties due to the infringement of their rights, in particular copyrights, license rights, competition rights or other property rights based on the content transmitted by the Creator. In such cases, the company is also entitled to hand over stored information to the claimant in order to prevent its own claims being asserted. The indemnification obligation also includes the assumption of reasonable legal costs incurred by the company.

Credit notes from the company are taxable according to the specified status (small business with reverse charge or company subject to VAT). The company helps the creator by writing the invoices on behalf of the creator and sending them to the creator (= credit note). The credit note is issued in accordance with the status specified by the creator.

The Creator is responsible for ensuring that the data is always up to date and that the tax classification is correct. Corresponding proof must be provided on request. If the Creator does not comply with the request, the account will be blocked for further payouts.

The Creator is prohibited from advertising other platforms on foxy.link or poaching users to other platforms. This also applies to fanseven, another portal of the Company, even if the Creator is listed there with the same account. The Creator may neither point Fans on foxy.link to their offering on fanseven nor direct them there, in particular not by naming fanseven, by links, profile names or paraphrases in chat messages, broadcast messages, the profile or content. Promoting the foxy.link profile outside both portals (e.g. on social networks) remains permitted. The Company may automatically scan chat messages for mentions of the other portal in order to verify compliance with this obligation. The Creator is prohibited from offering real meetings via foxy.link. The Creator is prohibited from accepting payments for real meetings via foxy.link.

The dissemination of illegal content, insults, threats, disparagement or third-party content via foxy.link is prohibited. Chat histories can be checked to monitor compliance.

In the event of an infringement, the Creator undertakes to pay a contractual penalty of €500 per infringement and the Creator account may be permanently blocked. Each attempt will be counted as a single violation. Any contractual penalties due will be offset against outstanding commission payments.

11.

The contract is concluded for an indefinite period and can be terminated without notice by either the Creator or the Company without giving reasons. Notice of termination must be given in text form. An e-mail with the notice of termination is sufficient.

12.

The Creator assures the accuracy of the information provided. Any changes will be communicated to the company immediately.
