The terms of use in German language apply exclusively. The following translation is for information purposes only.

You will be referred to as Creator in the following text.
We, Interwebs GmbH, are called Company in the following text.

1.

The Creator is given the opportunity to upload content that can be purchased and to conduct paid chats.

2.
The company takes over the sale of the content and chats. To enable the company to fulfill this task, the creator transfers all usage rights to the media and content provided to the company.

In return, unless otherwise agreed, the Creator receives a commission in the amount of the net value entered by the Creator per unit sold. The calculation basis is always the net value resulting from the gross value entered.
The price entry on foxy.link is made in gross values including the VAT applicable at that time.

The payout must be requested by the Creator in the account at https://foxy.link. The payout can be requested at intervals of 14 days, provided the balance is at least €10 net.

The payout is usually made 5 working days after the payout request. The banks' transfer times must be added together.
A fully completed and verified profile is a prerequisite for a payout. The creator must be authorized to receive payments.

Commissions are available for payment for 365 days from the time the commission is assigned to the Creator Account. After 365 days, the commission expires. It is no longer possible to request payment of commissions that are older than 365 days.

4.
The foxy.link service is aimed exclusively at persons of legal age (18 years of age or older). When registering, the Creator must provide proof that they are of legal age in order to use the service.

The Creator confirms to own the necessary rights to the content that is uploaded to foxy.link and then offered for sale by the company.

The creator can remove content from sale or delete it. This content will then no longer be offered for sale on foxy.link. Content already purchased by users is still available to them even after deletion.

The uploaded content may only show the verified creator himself. The depiction of persons other than the Creator themselves is prohibited. If the Creator publishes images of other people on foxy.link, this content will be deleted immediately and the profile permanently blocked. The entitlement to commissions will lapse completely.

Only one Creator profile may be created per person. Creating multiple profiles with the same civil identity will be considered an attempt to deceive and all profiles will be immediately and permanently blocked.

The Creator undertakes to behave in a lawful and conscientious manner. The following content is prohibited and may not be uploaded and offered for sale: Content with minors, content with animals, any content that can be associated with minors or simulates minors, KV (excrement) and vomit, depictions of violence, blood, injuries, mutilations and all processes that are prohibited by law or violate the guidelines of the Card Association.

The decision to accept an application as a Creator is the sole responsibility of the company. There is no right to use foxy.link.
The Company is solely responsible for deciding whether to enable or disable individual functions for the Creator. The Creator has no right to the activation or use of certain functions.
The Creator has no claim to a specific listing on foxy.link. The presentation, order or other highlights are the sole responsibility of the company.

8.
The Creator shall indemnify the Company against all claims asserted against the Company by third parties due to the infringement of their rights, in particular copyrights, license rights, competition rights or other property rights based on the content transmitted by the Creator. In such cases, the company is also entitled to hand over stored information to the claimant in order to prevent its own claims being asserted. The indemnification obligation also includes the assumption of reasonable legal costs incurred by the company.

9.
Credit notes from the company are taxable according to the specified status (small business with reverse charge or company subject to VAT). The company helps the creator by writing the invoices on behalf of the creator and sending them to the creator (= credit note). The credit note is issued in accordance with the status specified by the creator.

The Creator is responsible for ensuring that the data is always up to date and that the tax classification is correct. Corresponding proof must be provided on request. If the Creator does not comply with the request, the account will be blocked for further payouts.

10.
The Creator is prohibited from advertising other platforms on foxy.link or poaching users to other platforms.
The Creator is prohibited from offering real meetings via foxy.link. The Creator is prohibited from accepting payments for real meetings via foxy.link.

The dissemination of illegal content, insults, threats, disparagement or third-party content via foxy.link is prohibited. Chat histories can be checked to monitor compliance.

In the event of an infringement, the Creator undertakes to pay a contractual penalty of €500 per infringement and the Creator account may be permanently blocked. Each attempt will be counted as a single violation. Any contractual penalties due will be offset against outstanding commission payments.

11.
The contract is concluded for an indefinite period and can be terminated without notice by either the Creator or the Company without giving reasons. Notice of termination must be given in text form. An e-mail with the notice of termination is sufficient.

The Creator assures the accuracy of the information provided. Any changes will be communicated to the company immediately.
