Terms of use between the user (hereinafter referred to as user) and Interwebs GmbH (hereinafter referred to as operator).

The website foxy.link, all subdomains and all offers that link to the above-mentioned domains are hereinafter referred to as "foxy.link".

1. The following General Terms and Conditions apply to the use of foxy.link. Conflicting terms and conditions are not recognized by the operators. The terms of use serve to protect the rights of the user, the rights of the operator and the rights of third parties.

2. The offer of foxy.link includes the possibility to purchase free and paid content, as well as to exchange paid chat messages. The purchase contract is concluded between the user and the operator in the name and for the account of the operator.

3. The offer is aimed exclusively at persons of legal age (18 years of age or older). Persons who are not of legal age are excluded from using foxy.link.

4. The subject and price of fee-based offers from foxy.link can be found in the respective service description. The operator reserves the right to change these. The user will be informed on the website or by email before the changes come into effect. If no objection is raised before the change comes into effect, the change is deemed to have been approved. The credit is displayed in the user account in the form of a virtual currency called "foxy coins (fc)". The current balance can be viewed in the account at any time. A repayment of the credit is excluded.
   Deposits are processed via external payment service providers. The general terms and conditions of the respective payment provider apply.
   Content purchased by users is delivered by the operator in digital form in the user account. The user has the option of accessing the purchased content via foxy.link as part of their user account. Downloading the content is prohibited.

6. Content that may only be viewed by persons of legal age requires age verification by a recognized age verification system. Age verification is carried out using the recognized services offered on the website. After purchasing the relevant content, the customer is directed to the age verification selection and can choose between the services there. The use of an age verification system that is not listed is not permitted.

7. The user indemnifies the operator against all claims of third parties who assert claims against the operator due to the infringement of their rights, in particular copyrights, license rights, competition rights or other property rights due to the content transmitted by the user. In such cases, the operator is also entitled to hand over stored information to the claimant in order to prevent claims being made against it. The obligation to indemnify also includes the assumption of reasonable legal costs incurred by the operator.

8. When registering, the user is obliged to provide truthful information, not to register under a false identity and to keep all information up to date.

9. The user data selected by the user must be treated confidentially and may not be passed on to third parties. 12. If a payment cannot be collected due to insufficient funds in the account, unauthorized cancellation of the payment or other reasons for which the user is responsible, the operator is entitled to collect the payment plus any fees incurred. The operator is also entitled to commission a debt collection service. The fees incurred are to be borne by the user.

13. If a payment cannot be collected, the user's access to the account or the purchased content will be blocked. The concluded contract shall continue to run. A credit note for the use lost due to the blocking will not be issued. Access will be unblocked as soon as the outstanding amounts plus any applicable fees have been paid. Any subscription renewals due during the blocking period will be collected as soon as access has been reactivated by payment of the outstanding amounts.

14. Every activity on foxy.link is recorded. If a criminal offense is suspected, the identity of the user can be determined by the investigating authorities in conjunction with the data of the access provider.

15. The operator is only liable for contractual and tortious breaches of duty in cases of intent and gross negligence, unless a cardinal obligation is affected and there are no mandatory statutory provisions to the contrary.

16. The user is prohibited from poaching a Creator to another portal or communication platform/billing platform such as Skype, Whatsapp, Paypal or similar.

17. The user undertakes to behave in a lawful and conscientious manner. The following content is prohibited:
    The dissemination of illegal content

    • Insults, threats, disparagement
    • Content with minors
    • Content with animals
    • any content that can be associated with minors or that simulates minors
    • KV (excrement) and vomit
    • depictions of violence, blood, injuries, mutilations
    • all processes that are prohibited by law or violate the guidelines of the card association

The user is prohibited from making an appointment with a Creator for a real meeting or making a payment for a meeting via foxy.link.
If the user violates one or more of these rules, the user account will be irretrievably deleted with immediate effect. No compensation will be paid. All content and chat histories can be checked to monitor compliance with the guidelines.

18. The operator reserves the right to change the terms of use without giving reasons. The user will be informed of changes to the terms of use in good time via the website or by e-mail. If the new terms of use are not objected to, the terms of use shall be deemed to have been accepted. If the user objects to the new terms of use, membership shall be terminated with immediate effect.
